The Chamber of Petroleum Individuals (COPEC) has threatened lawful action against the National Petroleum Authority (NPA) above the introduction of a new levy on Liquefied Petroleum Gas (LPG).

The NPA in a circular to market players directed them to start charging 13.5 pesewas on just about every kilogram of LPG from April 1.

The NPA is also asking Oil marketing corporations to improve the levy on Gas Marking Margin from 3 pesewas to 4.5 pesewas for every litre on each and every item.

COPEC claims the present-day motion of the regulator is disappointing and unlawful.

In an job interview with JoyBusiness, the Govt Secretary of COPEC, Duncan Amoah mentioned, “this is incredibly appealing, I do believe the NPA itself recognize the illegality that it is really engaged in presently. For you to introduce any variety of levy, there is a legal routine that a person have to adhere to.”

“In Act 691 that establishes the NPA, the NPA has no mandate, energy in the set up to impose a new levy of these kinds of magnitude devoid of recourse to parliament”

Mr Amoah explained, “There is only a person legal framework for slapping any levy or taxes on Ghanaians that framework is by means of the Finance Ministry to Parliament for deliberations and approval and then it can arrive into effect.”

“The NPA is not clothed with power to sit and unilaterally drive levies or taxes on Ghanaians to get started shelling out as they have done and that we intend to contest critically.”

Cylinder Restoration Margin (CRM)

Mr Amoah reported the introduction of the Cylinder Restoration Margin evidently defeats the total intent of the Cylinder Recirculation Model.

“It can not be stated that even right before you believe of rolling out nationally, the financial consideration is heading forward of everything. We would have wished to see how the CRM would even function across the place, how many of the bottling vegetation you will be able to erect, how much you are ready to serve Ghanaians ahead of you even talk about problems of funds. Sadly, it seems to be as though right from the begin we are by now defeating the total essence of the Cylinder Recirculation Model by placing money forward of each individual other point.”

He added, “It cannot be said that we are previously charging Ghanaians for a certain support that they are not applying. You simply cannot cost individuals for a Cylinder Recovery Margin at the time when they are continue to applying their very own bottles. No branded bottles are in the program to be given to any individual if he/she went to the current market these days to refill his/her bottle, however you are charging them for a selected recovery. What are you getting people monies for?”
